This is a free seminar covering the following:-
The incorporation of the Remedies Directive into English law and with it the introduction of transparency notices has brought into sharp focus the use of the Regulation 14 (Public Contracts Regulations) provisions allowing procurements by negotiation without advertisement. In what circumstances is it legitimate to use these provisions and what are the risks of doing so?
o Using framework agreements -managing the risks in the light of the Remedies Directive and the new “ineffectiveness” remedy.
o Part B contracts – getting it right in the light of the Remedies Directive and the new “ineffectiveness” remedy.
o The approach to development agreements has changed following the well publicised decision in Roanne. How has that position changed following the Müller decision and how can the trap of inadvertently procuring a public work be avoided? Is it possible to re-badge a public works contract as a public works concession to avoid the full rigour of
the procurement rules?
